1. Interpretation and Definitions

For the purposes of these Terms and Conditions:

  • Service refers to the Trivia Night website and the interactive game provided, accessible from https://trivia-night.club.
  • Third-Party Hardware refers to any physical device not manufactured or sold by the Company that can be connected to or controlled by the Service, including but not limited to Lovense-branded interactive toys.
  • Account means a unique account created for You to access our Service or parts of our Service, authenticated via a Third-Party Social Media Service (Discord).
  • Other capitalized terms have the meanings defined throughout this document.

2. Acknowledgment

These are the Terms and Conditions governing the use of this Service. By creating an Account or using the Service, You agree to be bound by these Terms. You represent that you are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. The Service is not intended for individuals who do not meet this age requirement.

3. User Accounts

To use certain features of the Service, you must register for an account by authenticating with a third-party service, Discord. You agree to their Terms of Service and Privacy Policy. You are responsible for all activities that occur under your Account.

4. User Conduct and Rules

You agree not to misuse the Service. This includes, but is not limited to:

  • Engaging in any activity that is illegal, fraudulent, or harmful.
  • Attempting to cheat, manipulate game outcomes, or exploit bugs in the Service.
  • Harassing, abusing, or threatening other users.

We reserve the right to terminate or suspend your Account for any violation of these rules.

5. Intellectual Property

The Service and its original content (excluding content provided by you or other users), features, and functionality are and will remain the exclusive property of the Company and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company. You retain ownership of any data you provide to the Service, such as your user profile information and game performance data.

6. Third-Party Hardware and Integrations

The Service may offer integrations with Third-Party Hardware, such as Lovense toys, to enhance the user experience. Your use of any Third-Party Hardware is entirely at your own risk.

Disclaimer of Liability for Third-Party Hardware: You acknowledge and agree that:

  • The Company does not manufacture, sell, or endorse any Third-Party Hardware.
  • You are solely responsible for ensuring that any Third-Party Hardware is used safely, is in good working condition, and is used in accordance with its manufacturer's instructions and safety warnings.
  • The Company shall not be liable for any personal injury, property damage, discomfort, or any other damages arising from the use, misuse, or malfunction of any Third-Party Hardware connected to the Service.
  • Your use of such hardware is governed by the terms and privacy policies of the hardware manufacturer (e.g., Lovense), not by these Terms.

7. Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

8. Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for personal injury, loss of privacy, or property damage arising out of or in any way related to the use of or inability to use the Service or any Third-Party Hardware used with the Service).

9. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" without warranty of any kind. The Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Governing Law

The laws of Florida, United States, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

11. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to use the Service after revisions become effective, You agree to be bound by the revised terms.
